Terms of service (divers)

1. Acceptance

By creating a MyDiveTag diver profile or by using a participating dive shop's booking flow that runs on the MyDiveTag platform, you agree to these terms. If you don't agree, don't use the service.

2. What MyDiveTag is

MyDiveTag provides a diver identity layer (certifications, medical declaration, dive log, gear-service history) and tools for dive shops to take bookings, capture waivers, accept payment, and communicate with you. MyDiveTag is not a dive shop and does not provide diving services. The dive shop you transact with is the operator of any dive, course, or service you book.

3. Your account

  • You must be 18 or have a parent/guardian-managed account.
  • Provide accurate information, especially in the medical declaration. False or omitted medical information can put your life at risk and may relieve the dive shop of liability.
  • Keep your password and 2FA codes private. You're responsible for activity under your account.
  • Notify us immediately at security@mydivetag.com if you suspect your account has been compromised.

4. Diver data and dive shop relationships

You own your profile data. Each dive shop owns its booking, waiver, and marketing relationship with you. When you scan your MyDiveTag QR at a participating shop, you consent to that shop seeing your verified certifications, current medical status flag, and waivers you have signed with them. You can revoke marketing consent at any time without affecting your ability to book.

5. Free use

Diver profiles are free. We don't charge you for storing your certs, signing waivers, keeping a dive log, or scanning your QR at a participating shop. Dive shops pay for their use of the platform.

6. Payments

When you book with a dive shop, you pay the dive shop. MyDiveTag does not hold funds; payment processing is handled by Stripe under Stripe's terms. Refund decisions are at the dive shop's discretion within Australian Consumer Law.

7. Acceptable use

Don't try to break the platform, reverse-engineer it, scrape it, abuse rate limits, impersonate someone else, or use it to harass or harm others. We can suspend accounts that breach this section. Severe abuse may be reported to law enforcement.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Stripe, Cloudflare, Resend), or force-majeure events may interrupt access. Live medical/waiver information should not be the sole input to a safety-critical decision. The dive shop is responsible for the in-person briefing.

9. Liability

MyDiveTag provides a software service. The dive shop is responsible for the operation of the dive. To the maximum extent permitted by Australian law, MyDiveTag's aggregate liability to a diver is limited to AUD $100. Nothing in these terms limits consumer rights you cannot waive under Australian Consumer Law.

10. Termination

You can delete your account at any time from your dashboard or by emailing privacy@mydivetag.com. We may suspend accounts that breach these terms, with notice unless safety or law requires otherwise.

11. Governing law

These terms are governed by the laws of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.

12. Changes

We will notify registered users by email at least 14 days before material changes take effect.
